Terms of Service
Please read these terms carefully before using our service.
Effective date: October 12, 2026
Agreement to Terms
Accessible ("Service") is operated by L5 Ventures LLC, doing business as Accessible ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Accessible does not certify, guarantee, or warrant that your website or application complies with the ADA or any other accessibility law or standard.
Automated and AI-assisted testing can only evaluate part of any accessibility standard. Nothing the Service produces is a certification, and using it does not protect you from a claim. See Section 2.
1. Description of Service
Accessible is a web accessibility testing platform that helps developers identify and fix accessibility issues on their websites. Our service includes:
- AI-powered screen reader simulation
- Automated testing against WCAG success criteria
- User journey accessibility testing
- Detailed accessibility reports and recommendations
2. No Guarantee of Legal Compliance
2.1 No certification or guarantee. Accessible is a testing and reporting tool. Nothing produced by or obtained through the Service — including any accessibility score, WCAG level breakdown, issue list, remediation suggestion, dashboard, badge or seal, shared report link, activity report, or conformance report (including any VPAT or Accessibility Conformance Report export) — constitutes a certification, attestation, audit opinion, or guarantee that your website, application, document, or content complies with the Americans with Disabilities Act ("ADA"), Section 508 of the Rehabilitation Act, the Web Content Accessibility Guidelines ("WCAG"), the European Accessibility Act, EN 301 549, the Accessible Canada Act, or any other accessibility law, regulation, standard, procurement requirement, or contractual obligation.
2.2 Automated and AI-assisted testing is inherently partial. A substantial portion of WCAG success criteria cannot be evaluated by any automated tool and requires human judgment. Our screen reader simulations and journey testing extend that coverage but do not replace expert manual audit or testing with people with disabilities. Results may contain both false positives and false negatives, and the absence of a reported issue is not evidence that no barrier exists. A passing or clean result is a floor, not a certificate.
2.3 You remain responsible. You are solely responsible for the accessibility of your own websites, applications, and content; for determining which laws, standards, and contractual requirements apply to you; and for deciding what remediation to undertake and when. We recommend that you engage qualified accessibility professionals and legal counsel. Your use of the Service does not transfer any of that responsibility to us.
2.4 Not legal advice. The Service, its reports and recommendations, its documentation, and any guidance we publish or communicate are provided for informational purposes only and do not constitute legal advice. No attorney-client relationship is created by your use of the Service or by any communication with us.
2.5 No protection from claims. We do not warrant that use of the Service will prevent, reduce, resolve, or provide a defense against any demand letter, complaint, charge, audit, investigation, regulatory action, or litigation relating to accessibility, nor that it will satisfy any settlement, consent decree, or remediation obligation to which you are subject.
2.6 Statements to third parties. You may describe the testing activity you perform using the Service. You may not represent to any third party that your website, application, or content has been certified, verified, approved, or guaranteed as accessible or legally compliant by Accessible, and you may not present any output of the Service as such.
2.7 Precedence. This Section 2 applies notwithstanding anything to the contrary elsewhere in these Terms, in any marketing material, or in any statement made by us or our representatives.
3. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Subscription and Billing
Monitor (free plan): Monitor provides real-user accessibility monitoring for one domain per organization, with 1 seat, no payment method, and no expiry date. It does not include URL scanning, journey simulations, conformance or activity reports, exports, or a public posture page, and nothing it produces is a conformance claim (see Section 2). Monitoring history is retained for 30 days. We may withdraw or change the Monitor plan on 30 days' notice; this commitment is an exception to Section 8, and we will not withdraw Monitor without it.
Trials: A trial of a paid plan requires a valid payment method at sign-up and runs for 7 days. Unless you cancel before it ends, the plan converts and your payment method is charged at the price shown at checkout. There is no trial without a payment method. Each organization receives one trial, on its first paid plan; later plans and credit add-ons are charged from the start.
Fall-back to Monitor: If a paid subscription is canceled, goes unpaid, or a trial ends without converting, the domain moves to the Monitor plan rather than being deleted or suspended. Your monitoring continues; scanning, journeys, reports and exports stop until a plan is chosen again. Where an organization already has a Monitor domain, additional domains on the ended subscription become inactive instead.
Industry benchmarking: You tell us your organization's industry at sign-up and may change it in settings. We use de-identified, aggregated barrier statistics grouped by industry to publish benchmarks. Aggregates are only published for an industry represented by several organizations, and monitoring never collects page content, URLs beyond the route pattern, or data about your visitors.
Billing: Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
Price Changes: We may change subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to any systems or networks
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service beyond API limits
- Reverse engineer or attempt to extract source code from the Service
- Resell, sublicense, or redistribute the Service without authorization
- Use the Service to develop competing products
Sites you don't own. You may use the Service to check publicly available pages of websites you do not own. If a website's owner or operator asks us to stop testing their site, or we reasonably believe testing is burdening or harming it, we may stop testing that site and limit, suspend or terminate the access of any account that continues to test it, under Section 12.
Unlimited scanning and free page checks are subject to our Fair Use Policy, which forms part of these Terms.
6. Intellectual Property
Our Property: The Service, including all content, features, and functionality, is owned by L5 Ventures LLC and is protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of any content you submit to the Service. By using the Service, you grant us a limited license to process and analyze your content solely to provide the Service.
Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.
7. Data and Privacy
Your use of the Service is also governed by our Privacy & Security Policy. By using the Service, you consent to the collection and use of information as described in that policy.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice — except the Monitor plan, for which Section 4 commits us to notice. We shall not be liable for any modification, suspension, or discontinuation.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSIBLE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any damages resulting from your use or inability to use the Service
- Any damages exceeding the amount paid by you in the 12 months preceding the claim
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Test results will be accurate, complete, or free of false positives or negatives
- Any defects in the Service will be corrected
- Your website or application will comply with any accessibility law or standard (see Section 2)
11. Indemnification
You agree to indemnify, defend, and hold harmless Accessible and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Kansas.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
